Real Estate and the Minnesota Shut-Down

“With things in Minnesota not looking like they’re going to be resolved any time soon, many citizens are wondering about the effects that this shut-down is going to have. There are places of obvious effects, like state parks or organizations, but then there are also the less obvious secondary effects. One area that is feeling the pinch of the government shut down that people might not suspect is real estate.

Many areas of real estate fall under the umbrella of the state’s commerce department. The Commerce Department has several different branches that deal with such issues as consumer protection and fraud, and products like homeowners insurance. While much of the commerce department has remained open during the shut-down, the branch dealing with homeowners insurance that closed.

What effect will that have exactly? Well, products like home owners insurance are, by law, automatically approved after a certain number of days if no one in the office gets to them. With the entire office shut down, you can guarantee that no one is working on those products, and, soon enough, they’ll be automatically approved even if the products are structured badly or fraudulent. This won’t have any immediate effect, but it will affect home owners several years down the line, when they’re trying to be compensated for flood or storm damage.

The offices of the department dealing with insurance, mortgage, real estate, and debt collection have also all been shut down. With these offices closed, real estate agents can’t do things like apply to have buyers released from sales tax, nor could they found out an amount of a tax lien against a property. Both of these things could end up slowing down closings.

Even when the office begins working again, it will likely be a while before things are back to normal. Employees will most likely be under a mound of back paperwork, and will have to first deal with any urgent situations that arose during their absence before returning to the day to day duties that normally make up the bulk of their work. This means that some things could still be lost in the shuffle for a while after the government reopens.

Not everything is bad news, however. For the most part consumers and agents will be able to weather the government shut down. Some things that had the potential to turn disastrous, like agents losing their licenses because they couldn’t renew while the state was shut down, have been averted by the government allowing deadline extensions. And, since most filings happen at the county level, many home buyers won’t notice any change. Minnesota residents can also take comfort in the fact that this is a temporary situation and soon enough, things will normalize again.”

How To Avoid Potential Titling And Escrow Problems When Buying A Property Directly For Sale By Owner

When buying a home, it is very important that you are able to trust the people you are working with. Usually, when home purchases are considered, escrow payments are involved. This is a risk for many potential buyers who are buying property directly or for sale by owner, as the third party is one which cannot be trusted.

Therefore, you need to have security that your money would be in safe hands. In order to avoid potential titling and escrow problems when buying a property directly for sale by owner, there are several different methods that can be used. If all of these methods are implied properly, the chances of titling and escrow problems can be significantly lessened.

First of all, the third party that you choose with which to deposit the escrow payment should be trustworthy and reliable. Usually, it is important that when hiring a real estate broker, you make sure that you hire one that is trustworthy. This can be ensured by hiring a reputed real estate broker, as the chances of betrayal are minimized.

Secondly, before buying a property directly for sale by owner, it is important to make sure that you make sure that you know the landlord well. You must check the house carefully to ensure that it is a good buy at the price you are paying for it, and it is also very important to maintain good relations with the proprietor.

More importantly, before releasing an escrow payment, you must make sure that you have carefully calculated the percentage of the amount you are releasing. This is to ensure that there is no miscalculation later on when the full payment is released. As is expected, when a deal is done, the third party, or the real estate broker will require some commission, which may or may not be deducted from the escrow payment.

Therefore, it is important to have a written contract or agreement which specifies the exact amount of escrow that you will be paying, as well as the amount of deductions that would be made on it. This will make it very easy for all the involved parties to understand where the amount has been utilized. A written contract is also very important to ensure proper payment as well as truth of words.

Relying on the word of the property which is directly for sale by landlord is not the right thing to do, as you may not know them personally. Therefore, before buying property that is directly for sale by owner requires a written contract that has been properly drafted.

This should involve the specifics of the house that is for sale by owner, as well as the price that is being paid for it. Moreover, it should also include information about the real estate broker as well as the fee that has been charged by that person. Everything should be properly mentioned and signed so that there is very little chance for anything to go wrong later on and all parties should be agreed on it.
